1. Scope and acceptance
1.1 These terms govern your use of the shopfuneraleurope.com marketplace (the “Platform”) as a Buyer.
1.2 By ticking “I agree” at registration you accept these terms.
1.3 The Platform is for business use only. You confirm you are a funeral director, cemetery or crematorium operator, or other funeral-sector professional acting for business purposes. The Platform is not intended for consumers.
2. Role of the Platform
2.1 funeral europe is an intermediary connecting you with third-party Vendors.
2.2 The contract of sale is between you and the Vendor. funeral europe is not the seller and is not a party to that contract.
3. Account
3.1 Provide accurate business details and a valid VAT/tax number, and keep them current.
3.2 You are responsible for activity under your account and for credential security.
4. Orders and pricing
4.1 In the current manual model, placing an order is a request to purchase. The order is confirmed when the Vendor (or funeral europe on the Vendor’s behalf) confirms price, availability and terms.
4.2 Product information and prices are provided by Vendors and may change; obvious errors are not binding.
4.3 Prices are subject to applicable VAT. For valid intra-EU B2B orders, the reverse-charge mechanism may apply and VAT is accounted for by the Buyer.
5. Payment, delivery and risk
5.1 In the current manual phase, payment is arranged directly with the Vendor / as confirmed in the order.
5.2 Delivery, shipping times, risk transfer and packaging are the Vendor’s responsibility as stated in the listing or order confirmation.
6. Returns, warranties and after-sales
6.1 Returns, guarantees and after-sales support are provided by the Vendor under the sale contract and applicable B2B law. funeral europe is not responsible for the products or their conformity.
7. Acceptable use
7.1 Use the Platform lawfully. Do not misuse Vendor data, scrape content, or use listings for purposes other than legitimate procurement.
8. Intellectual property
8.1 Platform and listing content is protected. You may use it only to evaluate and place orders.
9. Data protection
9.1 funeral europe processes your data per its Privacy Policy in line with the GDPR and Spanish law. To fulfil orders, relevant data is shared with the applicable Vendor.
10. Liability
10.1 The Platform is provided “as is”. As an intermediary, funeral europe is not liable for Vendor products, Vendor conduct, or losses under the sale contract.
10.2 To the extent permitted by law, our total liability to you is limited to €100 or the fees (if any) you paid us in the prior 12 months, whichever is greater. Nothing limits liability that cannot be limited by law.
11. Changes
11.1 We may update these terms; the current version and effective date appear at the top. Continued use after changes constitutes acceptance.
12. Governing law
12.1 Spanish law; courts of Barcelona, without prejudice to mandatory rights.
